Recently, he worked on a successful appeal in which the Pennsylvania Superior Court overturned a $13 million trial verdict against a bank in a mortgage satisfaction case. In the intellectual property area, Clayton has handled litigation involving software licensing and copyright infringement as well as patent suits relating to laser and manufacturing technologies. He has also represented a major Philadelphia daily newspaper and two cable television broadcasters in several lawsuits involving claims for defamation and invasion of privacy.

A resident of center city Philadelphia, Clayton earned his Bachelor of Arts degree in 1990 cum laude, with a Distinction in English, and Master of Arts degree in 1990, both from the University of Pennsylvania. Clayton received his law degree from Columbia Law School in 1995, where he was a Harlan Fiske Stone Scholar and writing and research editor of the Columbia Journal of Law and Social Problems from 1993 to 1995. He clerked for the Hon. Joseph E. Irenas of the District of New Jersey before starting his career in private practice.
