The trial court permitted the mother to relocate with the parties' child. The matter was affirmed on at both the Appellate and Supreme Court levels. The case addressed an issue of first impression in New Jersey -- international relocation to a non-Hague country.
In a well-reasoned opinion, the Supreme Court expanded Bauers v. Lewis, and permitted the custodial mother to relocate to her native country to Japan, with the parties' minor child. MacKinnon v. MacKinnon, 191 N.J. 240, 922 A.2d 1252 (2007).
