BLF attorneys, including Lisa A. Barton, represented the University in a dispute with a general contractor, after stone panels on the exterior of a newly-constructed building began to exhibit cracking and spalling, creating a dangerous condition.

BLF advised the University and prepared a tolling agreement so that critical safety repairs could be completed before litigation commenced. In addition, BLF worked closely with the University to develop a plan to preserve evidence and provide access to opposing parties and their experts while the repairs were made, to avoid spoliation claims.

After the repairs were completed, BLF commenced litigation against the general contractor, who added third party claims against its subcontractors and suppliers.

The dispute was resolved through mediation.
