Sun Pharmaceutical Industries, Inc. v.

Core Tech Solutions, Inc.

BLF defended Core Tech Solutions, Inc., a small tech company that does research and development for pharmaceutical firms, against Sun Pharmaceutical Industries, Inc., a generic drug company, in a 2011 trial over an alleged breach of a letter of intent. The New Jersey Superior Court granted judgment in Core Tech’s favor at the end of plaintiff’s case.

On appeal, the Appellate Division unanimously affirmed in May, 2013, and ruled that the trial court correctly found that no breach of the obligation to negotiate in good faith had been established.
