Wayside Tavern, Inc., et al. v.

Hudson United Bank, et al.
(E.D. PA 2005)

BLF represented Hudson United Bank in an action brought by a granddaughter of the Bank's deceased elderly customer.

The lawsuit alleged that the Bank improperly refused to honor a power of attorney presented by the granddaughter to withdraw funds from the bank account set up by her grandfather and instead paid the balance of the account to another relative who was a joint signatory on the account. One of the key issues in the case was the validity of the power of attorney signed by the grandfather in the hospital the day before he died.

Following extensive discovery, including the circumstances surrounding the execution of the power of attorney, the case resolved in a favorable settlement for the Bank.
