D'Amico v. ACE Financial Solutions, et al.

A. Richard Feldman and Lisa A. Barton defended a workmen's compensation insurer and its third party claims administrator ("TPA") in an appeal to the Connecticut Supreme Court.

The issue on appeal was whether the employer’s statutory immunity from tort claims extended to an insurer that purchased a loss portfolio of the employer's existing workers' compensation claims, and the insurer's TPA.

BLF succeeded in getting the TPA dismissed on a motion for failure to prosecute, and, after briefing and oral argument, the Court dismissed the appeal against the insurer, as improvidently granted. D'Amico V. ACE Financial Solutions, et al., 61 A.3d 483 (Conn. 2013).
